1 . GENERAL CONDITIONS AND SCOPE
Excepting the case of special conditions stipulated in the special teams and conditions contractually agreed with customers or partners, the course of meal and the services associated with them – in particular entertainment – are subject to the general terms and conditions of sale, referred as “TCs”, prevails over all general conditions of purchase, the latter not being opposable to BUS TOQUE.
All reservations, written and oral are in full acceptance of all terms and conditions below.
BUS TOQUE reserves the right to change, modify, add or delete any part of these Terms and Conditions, at any time. Any modification if the TCs will be published on the website.
If one of the provision of these TCs was found to be void or unenforceable, the rest of the TCs would remain valid, unless the invalidation is an essential obligation whose removal or cancellation would prevent the continuation of the entire terms and conditions.
The applicable TCs are those accepted on the date of validation of the reservation.
In case of refusal by the Customer the acceptance of the TCs, the latter undertakes not to use the website or any of the services available.
Any reservation or purchase of a service automatically entails the acceptance of these Terms and Conditions.
2 – RESERVATION TERMS AND PRE-RESERVATION
Reservation or pre-reservation is mandatory (except last minute availabilities) and can be made by mail, internet and telephone. Online booking is the fastest, most common and convenient.
In order to make an internet reservation, the Customer must create an account on the website of BUS TOQUE by filling in a registration form: surname, first name, address, phone, date of birth will be required. All the data is confidential and can be accessed with the identifier and the password chosen by the Customer. The identifier must be provided each time the client access his account.
The Customer undertakes to provide accurate information, not to impersonate a third party or to change his age.
An email confirming the registration and the creation of the account will be sent to the Customer.
Once the Customer account created, the client is free to connect any time to view or modify his personal data, check a reservation.
In case of losing the password, the Customer has the possibility to reset it by clicking on the link: forgotten password.
BUS TOQUE draws attention to its Customers that the personal data in the Customer account are necessary for the management of the reservation. Such as: confirmation of the reservation, sending of the ticket and the TCs, but also in case of modification or cancellation of the event and any other communication of BUS TOQUE (promotional offers, credit card change, upcoming event, etc.)
The BUS TOQUE website has been designed to make booking as simple and intuitive as possible.
It is sufficient for the Customer to click on the BOOK icon, select the number of guests, day and time of his choice (depending on availability) and click on NEXT STEP.

The payment of the reservation will be done online by credit card. Once the payment accepted, a confirmation e-mail will be sent to the Client displaying the summary of his reservation and the present TCs in *.pdf version.
Once the booking confirmed, a voucher is sent to the Client The Customer must provide to the manager of the BUS the voucher at least 15 minutes before the departure time of BUS TOQUE. The manager will be in charge of checking the accuracy and veracity of the voucher before installing the Customer.
It’s imperative to respect the boarding times, which are indicated in the order confirmation. The bus must leave on time because it’s necessary to disrupt the agenda of its customers and the progress of its activity and other services.
This “voucher” is the exchangeable title against the resulting benefit; it is also a proof for the BUS TOQUE team that the reservation has been paid.

3. PRICE
The prices indicated on the website of BUS TOQUE during the reservation and those used in the restaurant are in euros (€) taxes (VAT) included. they can vary according to the event; expenses can be added to the price of the reservation (valid per person and per place).
Unless modified and agreed during the booking, the applicable fare conditions are those on the effective date to the final booking.
BUS TOQUE may revise rates at any time.
In case of price error, with may be due to a technical problem, BUS TOQUE reserves the right to refuse the reservation.
According to the provisions of Article L.313-6-2 of the Penal Code, “selling, offering for sale or exhibiting with a view to the sailor transfer or providing the means to sell or transfer tickets to a sport, cultural or commercial event live entertainment event, habitually and without consent of the producer or owner of the operating rights of that event or entertainment, is unusable by a fine of €15,000. The penalty is increased to €30,000 in the case of repeat offence”.
BUS TOQUE does not accept cheques and credit card payment of less than 15 euros.

4.SPECIFIC TERMS AND CONDITIONS
Route and schedules :
2024 Olympic Games : Les Bus Toqués will remain open during the Olympic Games 2024 season.
Our routes will be adapted according to traffic disruptions.
Exceptionally for reasons of traffic, events, works…our routes and schedules can be modified. In which case you will be informed as soon as possible.
In case of privatization, the place of the appointment for customer pick-up and drop-off can be chosen (Paris intramuros), subject to accessibility.
Change of menu :
For any specific requests concerning dietary habits and constraints, please inform us at least 7 days before the date of receipt of the reservation.
Overtime :
For any service beyond the hours agreed between the parties, a supplement of 600€ HT per hour started will be charged.
Change in the number of guests :
The number of guests announced on the balance due date will confirm the billing.
Pets :
Dogs are not allowed.
5. PAYMENT CONDITIONS AND SECURITY
The payment for the reservation can be made only by credit card (CB / Visa / MasterCard / American Express).
In case of payment by credit card the debit is made at the time of the reservation which becomes firm and final after confirmation of the bank issuing the card.
In case of bank refusal, the reservation will be automatically canceled and will remain to the customer account with the status “waiting for payment”.
BANQUE POPULAIRE endures the transactions processing and security, by encrypting bank details using the SSL protocol.
BUS TOQUE computer system never access the credit card information of the Customer.
In the event of fraudulent use of his credit card, after having contacted his bank, the Customer is invited to contact the Customer Service of BUS TOQUE who will indicate the procedure to follow:

For events and group bookings :
Your performance will be final upon receipt:
– An estimate signed with the mention “Good for agreement” with the stamp of the company, name and function of the signatory.
– Upon receipt of the 50% deposit
The quote is valid for 7 days from the date of publication.Privatization of the Bus: 50% deposit at the reservation and payment of the balance 1 month before the event;
Group booking: 50% deposit at the time of booking and payment of the balance 7 days before the event.
Any cancellation of your reservation will result in the loss of your payments.
6. MODIFICATION AND CANCELLATION
Events are under the responsibility of the organizer.
In case of cancellation of the event by BUS TOQUE, it may be decided to refund the customers up to the amount of the reservation by bank check sent by post.
In case of cancellation by decision of BUS TOQUE, customers will be notified as soon as possible by mail and/or SMS.
In case of malfunction of some mailboxes (saturate, spam etc.), Clients are invited to connect to their profile on the website of BUS TOQUE before the date of their event to verify that no modification or cancellation has been occurred.
In all of others cases (cancellation, modification or postponement of the event by decision of BUS TOQUE (loss or theft of the voucher, absence at the appointment, etc.) no refund or any other compensation for the reservation will be made.
Modification of reservation date:
– Up to 72 hours before the date of the event: 20% of modification fees will be applied. The request must be made by email to contact@bustoque.fr
– Less than 72 hours before the event: the date of the reservation cannot be changed and the reservation will be considered as cancelled. No refund will be possible.
Cancellation of reservation:
Reservations are not refundable in case of cancellation except in case of cancellation of the service by BUS TOQUE.
Concerning special events, such as: December 31st evening, February 14th evening, July 14th evening, August 15th evening, etc… non-exhaustive list, in case of partial or total cancellation by the customer less than 15 working days before the event, no refund, postponement or compensation can be granted. In case of national confinement, the customer will be entitled to ask for the postponement or the refund of his reservation. 7. RIGHT TO RETRACT

15. APPLICABLE LAW AND COMPETENT JURISDICTION
These TCs are subject to French Law.
The French Courts will be in charge in case of dispute.
